General terms and conditions gift vouchers
Maxpo Kft. (hereinafter the Issuer) defines the conditions for the purchase and use of the products/gift vouchers issued by it with these General Terms and Conditions (hereinafter GTC).
The content of the contract between the Issuer and the Buyer is determined – in addition to the provisions of the relevant legislation – by these General Terms and Conditions, as well as by additional information on the website www.5elements-massage-spa.hu. By sending the order, the Customer accepts the provisions of these General Terms and Conditions and acknowledges that they are an inseparable part of the contract between the Issuer and the Customer, and consents to data management in accordance with the provisions of the Data Protection Policy.

3. Scope of concepts and services:
3.1. Issuer: Maxpo Kft., which produces and sells the product / gift voucher.
3.2. Buyer: the person who buys a gift certificate / product for himself or the beneficiary.
3.3. Beneficiary: a third party entitled to use the E-voucher/receive the product, whose name can be included on the gift voucher at the customer’s request.
3.4. Voucher holder: the third party entitled to use the E-voucher who owns the gift card.
3.5. Gift voucher – an electronic gift voucher (E-voucher) issued by the Issuer and available for purchase on the Issuer's website can be of two types:
1. Gift vouchers with predetermined denominations indicated on the website (hereinafter: “type 1 gift voucher”), which can be used in any of the 5 Elements Spa salon’s;
2. Gift vouchers for a specific procedure (hereinafter: type 2 gift voucher), with a mandatory indication of its duration. This type of E-voucher can only be used at the address indicated on it.
3.6. Gift voucher value: the amount shown on the website as the price/value of the E-voucher.
3.7. Gift voucher validity period: 5 (five) months from the date of issue, within which time thegift voucher can be redeemed, which cannot be extended. The expiration date and expiration date are indicated on the Gift Voucher.
3.8. Type 1 gift voucher service: for any procedure and service indicated on the Issuer’s website for the amount specified in the voucher.
3.9. Type 2 gift voucher service: only for the procedures and duration specified in the voucher.
3.10. Place of fulfillment (use): the address is on the electronic gift card.
3.11. There is no way to refund the value of the Gift Voucher or the amount not used before the expiration date.
3.12. The Voucher Holder is entitled to use the Gift Voucher. Neither the Issuer nor its staff at the point of use investigates the ownership of the E-voucher.
3.13. In case of loss or destruction of an unused, printed Gift Voucher, the Buyer or Beneficiary is not entitled to re-claim the Gift Voucher, and the Issuer is not obliged to replace it. It is not possible to reclaim the purchase price.
4. Online ordering procedure:
4.1. Selecting the gift card.
4.1.1. Type 1 gift card. The customer can select the desired voucher by clicking on the different price categories in the “Web shop” menu of the website.
4.1.2. Type 2 gift certificate. The customer can select the desired voucher by first selecting the salon where the gift voucher will be used.
4.2. Entering data related to the purchase During the order, it is necessary to enter the data related to invoicing (first name, last name, address (country, street, house number, city, county, postal code), e-mail address, telephone number). In the "Order notes" text box, the Customer can enter any information related to his order.
4.3. Payment, sending the order during the online purchase, the Buyer finalizes and sends the order to the Issuer by entering the data and paying the purchase price of the voucher, by which he accepts the provisions of these General Terms and Conditions and acknowledges that they are inseparable from the contract between the Issuer and the Buyer gap and consents to data management in accordance with the provisions of the Data Protection Regulations.
4.4. Confirmation In case of successful payment – if the electronic voucher was selected as the delivery method – to the e-mail address provided by the Buyer. In the case of postal delivery or personal collection, the Issuer only sends a confirmation notification.
5. Payment terms:
5.1. Payment of the purchase price of the voucher via the online payment interface is only possible by payment by bank card through Barion system.
5.2. Online bank card and other payment methods are implemented through Barion system. The bank card and other payment-related data do not reach the merchant. Barion Payment Zrt., which provides the service, is an institution under the supervision of the Magyar Nemzeti Bank, license number: H-EN-I-1064/2013.
6. Purchase price of the voucher:
The purchase price of the Gift Voucher on the website includes VAT.
7. Delivery methods and deadlines:
7.1. The delivery of the gift voucher takes place after the online payment of the gift voucher, during business hours, within 2 hours on average, but within 24 hours at most.
7.2. Electronic Gift Voucher is delivered to the e-mail address provided by the Customer electronically, in the form of a downloadable file, free of charge (in PDF format).
7.3. If you choose to pick it up in person, the printed gift card can be picked up at the points of use during opening hours.
8. Voucher redemption:
8.1. The Gift Voucher can only be redeemed in 5 Elements Spa salons during the validity period indicated on the voucher.
8.2. The Voucher Holder is entitled to use services of the specified value during the opening hours of the Issuer’s salons, after making a prior reservation and presenting an undamaged, identifiable Gift Voucher.
8.3. The Voucher Holder is obliged to indicate to the place of use that he wishes to redeem a Gift Voucher at the time of the preliminary reservation.
8.4. The electronic Gift Voucher can be presented in both printed and digital form.
9. Cancellation of the order:
9.1. The Buyer may withdraw from the absentee contract in writing within 14 (fourteen) calendar days from receipt of the ordered voucher, without giving reasons.
9.2. The Customer can also exercise his right of withdrawal in the period between the date of conclusion of the contract and the date of receipt of the voucher.
9.3. In case of cancellation, the Issuer and the place of use will delete the Gift Voucher as a usable voucher.
9.4. In case of exercising the right of withdrawal, the Issuer is obliged to refund the amount paid by the Buyer to the Buyer immediately, but no later than within 14 (fourteen) days from the date of learning about the withdrawal.
9.5. If the Gift Voucher is used or redeemed, the contract is deemed to have been fulfilled in accordance with the contract, so it is not possible to withdraw from it.
10. Procedure for handling complaints:
10.1. The aim of the Issuer and the place of use is to complete the order to the complete satisfaction of the Buyer and the user of the service. If the Buyer or the Voucher Holder still has any complaint regarding the contract or its performance, he can communicate his

10.2. The Issuer investigates the verbal complaint immediately and remedies it as necessary. If the person concerned does not agree with the handling of the complaint or the immediate investigation of the complaint is not possible, the Issuer will immediately record the complaint and its position on it and send a copy of it to the complainant by e-mail.
10.3. The Issuer will investigate the written complaint in writing within 30 days. He gives reasons for his position rejecting the complaint. The minutes of the complaint and the copy of the response are kept by the Issuer for five years and presented to the inspection authorities upon their request.
10.4. If the complaint is rejected, an official procedure or a conciliation board procedure can be initiated.
10.5. The complainant can also contact the consumer protection authority. Government offices act as general consumer protection authorities: http://www.kormanyhivatal.hu/hu/elerhetosegek.
10.6. In the event of a complaint, it is possible to contact a conciliation body, whose contact information can be found on the website www.bekeltetes.hu.
10.7. Civil litigation or non-litigation proceedings can also be initiated to enforce the claim.
11. Data protection:
11.1. The Data Management Policy is available on the website indicated above.
12. Final provisions:
12.1. The Issuer is entitled to amend these General Terms and Conditions unilaterally.
12.2. In matters not regulated in the General Terms and Conditions, Hungarian law is the governing law.
